The 27th session of the 12th National Assembly (NA) Standing Committee opened in Hanoi on January 18 with Nguyen Phu Trong in the chair. During the January 18-19 session, the Standing Committee will give opinions on six important law drafts.

At the 18 January session, the NA Standing Committee discussed six major issues on the law draft on trade arbitration such as violation of the jurisdiction of settling trade arbitrators’ disputes, arbitrator’s standards, foreign-element-related arbitrators and the authority of the arbitration council in applying temporary urgent measures.

Regarding violation of the jurisdiction of settling trade arbitrators’ disputes, NA deputies agreed on project 1 of the law draft under which they said that they should not extend trade arbitrators’ jurisdiction for settling civil disputes as they are only entitled to deal with trade disputes.

In terms of foreign-element-related arbitrators, NA deputies underlined the need to build a separate chapter for regulating foreign-element-related arbitrators. However, they said, it is essential to supplement regulations on conditions and procedures for foreign arbitrator’s activities and settling foreign element- related disputes.

The same day, the NA Standing Committee also gave opinions on supplements to the draft law on public investment and a resolution on amendments and supplements to some articles under resolution No 66 on key national projects to decide on investment in the law and ordinance-making programmes of the 12th NA in 2010.

Concerning the draft law on public investment, NA deputies said it is imperative to build a law on public investment to avoid regulations overlapping with current ones based on the laws on construction, investment and State budget.
